Spain’s rights collection entity Egeda and the World Intellectual Property Organization have
reached an agreement which sees WIPO developing specific Expedited Arbitration Rules for Egeda.
New rules, announced Wednesday at San Sebastián,complement Egeda’s internal systemá for resolving conflicts between its film and TV associated rightholders.
Advantages for Egeda partners include timesaving: Under the new rules, one sole arbitrator will issue rulings in a conflict in a maximum three months, said Ignacio de Castro, deputy director at WIPO Arbitration and Mediation Center.Egeda members accessing WIPO Expedited Arbitration Rules must pay a ¤400 administrative fee. plus up to ¤4,000 as arbitrators’ professional fees.
WIPO will announce its decision over conflicts to the parties and Egeda.After that, Egeda will total or partially release moneys frozen from the dispute.
Since effectiveness largely depends on the quality of the arbiter,Geneva-based WIPO boast an international list of more than 1,500 arbiters, mediators and indie experts from around 70 countries.
WIPO signed three years ago a similar deal with international indie producers’ collection society Agicoa.
De Castro unveiled international statistics for intellectual property disputes: At the mediation stage, parties reached settlements in 73% of conflicts. Figure drops to 54% for those in arbitration.
