One. Purpose of the competition and sponsoring companies
The Films in Progress Industry Award aims to help complete and distribute in Spain a Latin American feature film from among those included in the Films in Progress selection at the San Sebastian Festival.
The Industry Award is open to 100% Latin American productions or co-productions with Spain, provided that Spanish participation is no higher than 49% of the total film production and that they accept the conditions stipulated in point 4 of these rules.
Thus, the film winning the award will receive the different post-production and distribution services in Spain, detailed below and provided by the sponsoring companies: Daniel Goldstein, Deluxe Spain, Dolby Iberia, Laserfilm, S.L., Nephilim producciones S.L., No Problem Sonido and Vértigo Films, S.L.
Two. Participation requirements and conditions
Simply by presenting candidate projects to the Films in Progress Industry Award implies unlimited and unrestricted acceptance of these rules by the participating production companies.
Three. Film selection process and presenting the award
A Jury consisting of representatives from each of the companies sponsoring this section (as mentioned above) will select the winning film after having viewed the works that require the services they offer and examining their situation.
The decisions taken by the Jury will be final.
The winning film will be announced at the San Sebastian Festival.
Four. Co-production contract and participation quota
On behalf of the (aforementioned) sponsoring companies, NEPHILIM PRODUCCIONES, S.L. will sign a financial co-production contract with the winning production company in order that the winning film may obtain Spanish nationality for the purposes of improved commercialisation in Spain. This contract, whose text will be worded by NEPHILIM PRODUCCIONES, S.L., will be signed within a maximum of three months from the moment the Award is accepted by the winning production company and, in any case, before the post-production work begins. Failure to sign this contract will imply automatic loss of the award.
Under the said contract, NEPHILIM PRODUCCIONES, S.L. will become the audiovisual co-producer of the film and will therefore hold full rights to it. NEPHILIM PRODUCCIONES, S.L. will also obtain 100% of the exclusive film rights in Spain and non-exclusive film rights in Andorra.
Commercialisation of the film in Spain and Andorra will be decided and carried out by NEPHILIM PRODUCCIONES, S.L.
The winning production company shall guarantee that it owns the licensing rights to the film and that it is authorised to sign this co-production contract with NEPHILIM PRODUCCIONES, S.L. in the above terms. In the event that this guarantee fails to materialise, the production company will be held responsible for compensation to NEPHILIM PRODUCCIONES, S.L.
Five. Obligations of the winning production company
The winning production company undertakes to:
- Provide all the material required to carry out the post-production work included in the award, no later than 15th December of the year that the award is granted;
- Include in all opening credits for the film that it is the winner of the “Films in Progress Industry” Award, including the Films in Progress – San Sebastian Film Festival logo and the logos of all the sponsoring companies. Mention must also be made of the Award in all material to promote and advertise the film (poster, website, etc.);
- Allow the sponsoring companies to use the title of the film and the film itself, directly and indirectly, as promotional and advertising material for their own activities;
- Deliver to NEPHILIM PRODUCCIONES 30 posters and 60 DVDs of the film (cover and case) in the shortest possible time, and no later than four months from the date of its release in any region. The production company undertakes to send the final design of the poster to NEPHILIM PRODUCCIONES in order that it may supervise the correct position of the logos of the companies sponsoring Films in Progress.
Six. Obligations of the companies sponsoring the Award
The companies sponsoring the award shall carry out the post-production tasks that are their responsibility in accordance with the following description, no later than 31st July of the year after the one in which the award is presented. This work shall always be carried out following a work schedule that the companies themselves have designed and which the company producing the film must accept:
- DANIEL GOLDSTEIN, S.L. will be responsible for:
- Sound post-production work on the winning film, by providing the following:
- Dolby and print master mixing room, for a maximum of 80 hours.
- Materials to be delivered:
- Pro Tools session at 24 fps per reel of the 5.1 mix, LT RT Mix.
- Pro Tools session at continuous 25 fps with the 5.1 mix and LT RT Mix.
- DELUXE SPAIN is responsible for:
- Cleaning the negative (if it has been shot on film and such a task is required)
- Scanning the negative (for Intermediate Digital and shots for digital effects)
- Creating an EDL in high definition, completed and provided by the customer.
- Providing digital effects, opening and closing title sequences.
- Up to 80 hours of colour correction.
- Obtaining the DCP master (Digital Cinema Package).
In the event that the Deliveries for international sales are awarded to Deluxe Spain as a result of intermediation by the production company winning the Films in Progress Industry Award, it will pay 3% of the total invoice for the contract in question. This payment will not be made in the event that the distributor has a prior agreement with Deluxe Spain for carrying out said work.
- DOLBY IBERIA, S.L. will provide the services included in its Motion Picture Service Agreement (MSPA).
- KODAK S.A will provide the image and sound material required in 35mm until obtaining the first standard copy.
- LASERFILM will provide translation, adaptation and location of the English subtitles of the film, including a day of simulation with the native translator. It will also add the subtitles to the DCP.
- NEPHILIM PRODUCCIONES S.L. will coordinate the post-production work and licensing of the film in Spain and Andorra as envisaged in these rules and in the co-production contract.
- NO PROBLEM SONIDO S.L. will provide the sound editing.
- VERTIGO FILMS, S.A. guarantees release of the winning film in cinemas in Spain, and the corresponding advertising. The release will take place within 18 months from delivery of the first master copy of the film.
Any additional work to the above will be the responsibility of the production company and must be requested from the corresponding company.
